Questions practitioners ask
Are reports admissible as evidence?
Every finding in a BLACKEYES report is source-cited, referencing the underlying public source. Reports have been used to support matrimonial, due diligence, and commercial matters. Whether a specific finding is admissible and carries evidential weight depends on the tribunal, the matter, and whether the finding has been independently verified. Chain-of-custody handling and expert-witness framing may be required for contentious work. Counsel decides the evidential treatment — BLACKEYES does not.
Can we rely on the findings without further verification?
No. Findings are aggregated from public sources, historical data breaches, and third-party APIs including Companies House. The pipeline combines those lookups with AI analysis. While we apply multi-stage verification and Skeptic gating, AI systems can still misattribute signals, third-party data can be out of date, and breach records can be incorrect. For any finding that will be relied on in proceedings, independent verification is essential. BLACKEYES is not liable for third-party data accuracy or for how findings are used.
Whose responsibility is the lawful basis for processing?
Your firm's. UK GDPR and the Data Protection Act 2018 give several lawful bases that might apply — legitimate interest, legal claims, substantial public interest — but which applies in a specific matter is for your firm's DPO or counsel to determine and document. BLACKEYES acts as Data Processor on your instruction. We don't certify your lawful basis and aren't liable for processing lawfulness beyond our technical processor obligations.
Can opposing counsel request disclosure of our report?
Reports are based on public-domain information that the opposing side could in principle obtain themselves. Any report relied on in proceedings may be subject to standard disclosure rules. Because every finding is sourced, the report facilitates disclosure and cross-examination rather than obstructing it.
Do you work with chambers or barristers directly?
Yes. Chambers, barristers, and instructing solicitors all use the platform. Reports are delivered to the user who ran them — an instructing solicitor can commission a report and share the output with instructed counsel as part of the brief.
Is there a confidentiality issue using an external platform?
Reports and investigations are visible only to your account. BLACKEYES staff do not read report contents except with your explicit request during support. The underlying investigation queries against public sources do not disclose the matter or client. Investigation data is encrypted at rest and in transit.
